Wheaton Expungement Attorneys
Lawyers for Criminal Record Sealing and Expungement in DuPage County
A criminal record or arrest history can negatively impact your life for many years. Even if you were never convicted of a crime, your arrest record and the formal charges filed against you can create difficulties in obtaining employment, as well as housing and educational opportunities. Convictions can be even more serious, since many employers refuse to hire former felons, and landlords may not want to rent property to tenants who have a criminal history. Because of this, it is important to understand the options for removing information about arrests or convictions from your record.
At Mirabella, Kincaid, Frederick & Mirabella, LLC, we are proud to assist eligible clients in clearing their criminal records through expungement. With our experience and legal skill, our attorneys can help restore your reputation and minimize the negative effects that you may experience because of issues that have occurred in your past.
Expungement Lawyers in Wheaton
Under Illinois law, you may seek to have your criminal records expunged or erased even if you have previously been convicted of a crime. If your petition for expungement is granted, all affected arrest records maintained by the State of Illinois may be wiped from your record. In addition, all related court documents will be erased, as if you had never been arrested.
You may be eligible for expungement if:
- You were arrested but never formally charged;
- Charges against you were dropped or dismissed;
- You were found not guilty of the charges;
- Your case was overturned on appeal;
- You were pardoned by the Governor;
- You were convicted of a misdemeanor or Class 4 felony offense involving cannabis prior to January 1, 2020;
- You pled guilty or were found guilty, but received a sentence of court supervision (with certain exceptions); or
- You pled guilty or were found guilty, but received and completed a sentence of qualified probation.
If you have made a mistake in the past, you should not be punished for the rest of your life. Our skilled expungement attorneys can assist you in clearing your name and moving on with your life.
DuPage County Attorneys Helping Clients With Record Sealing
When you contact Mirabella, Kincaid, Frederick & Mirabella, LLC, our team of skilled attorneys will work with you to determine your eligibility for expungement. If you are not eligible, however, we may be able to help you pursue the sealing of your criminal record. You can seal records related to most misdemeanor convictions, as well as some felonies. There are some exceptions, including convictions for domestic battery, sex crimes, violation of an order of protection, or DUI. Waiting periods will also apply, and in most cases, sealing will be available three years after the completion of a sentence. By sealing your conviction record, eligible offenses will no longer show up on regular background checks. Certain agencies may still be able to access the sealed records, but only for very limited purposes.
